How does COVID-19 effect the playing of rounds?

All of the auction rounds will be played in 2021 unless otherwise noted. Winners will coordinate with host members/clubs to find a date that works for all parties.

 

As the COVID-19 situation continues some courses may experience closures. This may effect the timing of when rounds are played.

Are caddy fees included?

No, the winner of the auction item is responsible for all caddy fees including gratuity (unless otherwise noted).

Are travel and accommodations included in the auction experiences?

Travel and associated expenses are not included (unless otherwise noted).

 

Each winning bidder bears the responsibility of transportation, lodging and all other expenses associated with getting to and from the experience. You are bidding on only the auction experience as detailed in the auction item description.

Is the entire amount of my charity auction bid tax deductible?

The final bid amount you pay above fair market value may be tax deductible by you as a charitable contribution. You should consult your tax adviser to determine the appropriate tax treatment.

Can I retract a bid?

No, and we're pretty strict about this. All bids placed on the Member for a Day website are legally binding. If you are the successful bidder, you will enter into a legal contract to purchase the item and will be considered the buyer of the lot. Please consider your bids carefully before placing them.

Member for a Day Auction Rules

1. By bidding in this silent auction, each bidder agrees to these auction rules.

2. All sales are final. There will be no exchanges or refunds unless otherwise noted. All items are “as is.” Member for a Day LLC has attempted to describe and catalog items and experiences correctly, but neither warrants nor represents and in no event shall be responsible for the correctness of descriptions, genuineness, authorship, provenance, or condition of the items and experiences. No statement made in this promotion, or made orally at the auction or elsewhere, shall be deemed such a warranty, representation, or assumption of liability.

3. Proceeds from the auction go to the charity listed.

4. Auction item values are good faith estimates of fair market value. Items have not been independently appraised unless so noted. The amount you pay above fair market value may be tax deductible by you as a charitable contribution. You should consult your tax adviser to determine the appropriate tax treatment.

5. Transportation, lodging, and other expenses associated with getting to and from the location of the experience are the responsibility of the auction winner.

6. Payment for items and experiences purchased must be made in full within [3] days of winning. If payment is not completed within [3] days, the winning bidder will forfeit their winning bid and the item or experience will be provided to the next highest bidder.

7. Member for a Day LLC reserves the right to add or withdraw items, without notice, to or from the auction.

8. Member for a Day LLC reserves the right to refuse or decline any winning bid if commercially reasonable to do so or if acceptance of such bid would have a negative or disparaging effect with respect to Member for a Day LLC, its products, personnel, agents or sponsored talent.

9. Unless otherwise specified, all auction experiences must be used within 12 months of the date of the conclusion of the auction.  Specific scheduling will be mutually agreed upon.

10. Each person bidding assumes all risks and hazards related to the auction and items and experiences obtained at the auction. Each bidder agrees to hold harmless Member for a Day LLC, its elected and appointed officials, members and employees, the auctioneer(s), the auction company and its agents and employees, the event organizers, sponsors, and/or volunteers from any liability, loss or damages connected with the auction and subsequent item or experience.

11. Any attempt to deliberately damage any website or to undermine the legitimate operation of this auction is a violation of criminal and civil laws, and should such an attempt be made, Member for a Day LLC reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution

12. Member for a Day LLC may screen auction winners and their guests for suitability regarding celebrity experiences. In certain cases, a criminal background check is conducted with the winner's consent.

13. This agreement shall be governed by the laws of the State of South Carolina, without regard to conflicts of laws rules.
